These Terms of Use apply to dreamhomeworks.com (the “site”), which is operated by America’s Vinyl Exteriors, Inc., doing business as America’s Dream HomeWorks (“we”, “us”, “our”). Part 1 covers your use of the site. Part 2 covers our text message program. By using the site, you agree to Part 1. Part 2 applies if you receive text messages from us. If you do not agree, please do not use the site.

Part 1. Using this site

The site is information, not a contract for work

The site describes our remodeling, cabinetry, countertop and related services, shows examples of projects, and lets you ask us to contact you. Nothing on the site is an offer to perform work or a price quote for your home. Any work we perform is governed by a written home improvement contract signed by you and by us, which sets out the scope, price, schedule, warranty and your cancellation rights. If anything on the site differs from your signed contract, the contract controls.

Information, photos and promotions

We try to keep the site accurate and current, but products, materials, colors, finishes, availability and service areas change, and the site may contain errors. Photos show examples of projects and materials; your project will depend on your home, your selections and your contract. Offers, discounts and financing mentioned on the site are subject to the terms and dates stated with them and to approval where applicable. We may change or end an offer before its stated end date only where the offer’s terms allow it, and a change never affects an offer already written into your signed contract. Financing is provided by third-party lenders under their own terms.

Contacting us through the site

When you submit a form, please give accurate information about yourself and your project and only submit information you are entitled to share. How we contact you after you submit a form, and how we handle your information, are described in the notices on the form and in our Privacy Policy at dreamhomeworks.com/privacy-policy/.

Acceptable use

You agree not to misuse the site. For example, you will not: submit false information or information about another person without their permission; attempt to gain unauthorized access to the site or its systems; interfere with the site’s operation, including by introducing malicious code or by overloading it; or copy large portions of the site by automated means for commercial purposes without our written permission.

Our content

The text, photos, videos, logos, trademarks and other materials on the site belong to us or to the people who licensed them to us. You may view and print pages for your own personal, non-commercial use, such as planning a project. Any other use requires our written permission.

Reviews and feedback

You are free to share your honest opinion of our work anywhere you choose, including on review sites. Nothing in these Terms limits that right. If you send us feedback or suggestions, you give us a non-exclusive, royalty-free license to use them.

Links to other sites

The site links to other websites and services, such as manufacturers, review platforms, financing partners and social media. We do not control those sites and are not responsible for their content or practices; their own terms and privacy policies apply.

Disclaimers

We provide the site “as is” and “as available.” To the fullest extent permitted by law, we make no warranties about the site itself, including that it will be uninterrupted, error-free or free of harmful components. This does not affect any warranty stated in your signed contract or any warranty that the law gives you and that cannot be waived.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages arising from your use of the site. This section does not limit our liability for our fraud, willful misconduct or violation of law, for personal injury, or for anything else that the law does not allow us to limit, and it does not change our obligations under a signed contract.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. This does not take away any protection given to you by the law of the state where you live.

Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a new “Last updated” date. The version posted when you use the site applies to that use.

Part 2. Text message program terms

What the program is

America’s Dream HomeWorks Text Messages. America’s Dream HomeWorks sends text messages about requests and projects and, with your consent, marketing messages such as offers and updates.

How you join

You receive messages about your request or project when you contact us or ask us to contact you. If you text us, we will reply about your message. You receive marketing messages only if you check the box on one of our website forms agreeing to them, or give us that consent in another written way. Marketing messages may be sent using automated technology. Your consent to marketing messages is not a condition of buying any product or service.

Message frequency and cost

Message frequency varies. Message and data rates may apply, depending on your mobile plan.

How to stop, and how to get help

You may opt out at any time by replying STOP, QUIT, END, CANCEL, OPT OUT, REVOKE or UNSUBSCRIBE to any message, or by telling us in any other reasonable way, including through the request form at dreamhomeworks.com/privacy-request/. When you opt out, we will stop sending you automated text messages. We may send one final message confirming your request; it will not contain marketing and may ask whether you still want texts about an active project. If you do not reply to confirm, we will not send further automated texts. Reply HELP for help, or call us toll-free at 888-530-8395.

Carriers

Wireless carriers are not liable for delayed or undelivered messages.

Privacy

We do not sell your mobile phone number or your text-message consent, and we do not share them with third parties or affiliates for those parties’ own marketing or promotional purposes. How we handle other information, including your right to opt out of sharing for advertising, is described in our Privacy Policy at dreamhomeworks.com/privacy-policy/.
